If any new and important written evidence, which was not brought to the knowledge of the plaintiff or the defendant at the time of filing the plaint or the reply, comes to the knowledge or is discovered later, the plaintiff or the defendant may seek permission to present such evidence and if such action is deemed appropriate, the court may permit the plaintiff or the defendant to present such evidence. .
(2) If the plaintiff or the defendant submits an application to the court stating the reason why it is not possible to present the evidence as per sub-section (1) because it is under the control of another person, institution or body, the court may issue an order to produce such evidence in accordance with sub-section (2) of section 162.
